Child removal survey

We are circulating this survey being carried out by Right to Equality, which, like us, is campaigning for abolitionl of the law which says that children should have contact with both parents (‘Presumption of Contact’) regardless of any violence fathers commit against mothers/children. They want to hear from mothers in private law proceedings in family court whose children have been taken from them, especially after being accused of “parental alienation”, the allegation so widely used by abusive fathers. RTE say: “The purpose of this survey is to understand how the family court responds to allegations of domestic abuse in private law family court proceedings. 

Concerns have been raised about the removal of children from their primary carers by family courts in private law proceedings on the basis that they have alienated their children from the other parent by raising allegations of domestic or sexual abuse (Barnett, 2020; Domestic Abuse Commissioner, 2023; Grey, 2023; Harm panel Report, 2020, United National General Assembly Human Rights Panel). However, there is currently no systematic data collection in England and Wales to evidence the existence and extent of this practice.

Right to Equality and Survivor Family Network have written a short survey to obtain indicative data about these issues. They are looking for primary carer parents across England and Wales who have had children removed from their care as a result of private law family court proceedings that involved child contact disputes with an ex-partner. 

The survey should take no longer than 10-15 minutes to complete and has been carefully designed with advice from academics, legal practitioners and those with lived experience of private law family court and child removal.” 

The survey closes on 17th September 2025.
